I don't truly believe capital punishment is a deterrent because death penalty crimes don't seem to be declining. (I have no stats on this, just a perception).
the appeals process is so long, that a death sentence practically guarantees the criminal another 10 years of life at least. in some places, it probably extends their life, keeping them warm and safe and well fed while some lawyer sits around and thinks of more and more futile reasons why the sentence should be overturned or whatever. I think if the appeals process was limited and a time frame in place from sentencing to execution, it may have more effect. I don't know. it's one of those things that no one has any good answers for.
perhaps a more Biblical approach is needed, the whole "eye for an eye" thing. if a guy knows that raping his girlfriend is going to get him raped, he might think twice about it. (I hear guy's are sensy about their butt holes.)
