Last place I worked would fire people for really any reason and it was hard to fight because they're a giant corporation who doesn't care. I got fired
for taking 10 minutes extra on my break. I had been sick and wasn't allowed to have a day off to recover and fell asleep on my break, then had to spend
extra time horking in the employee bathroom. I filed for unemployment and was denied, so I went through a hearing process and they found that my firing was
unjust. W00t! Though for every one of me, there's a thousand others who get screwed.
Current job hasn't actually fired anyone because we usually wind up with employees who either walk out without notice at the time we need them most because they got a better offer, out or get deployed. Though we did fire a couple cleaning companies who overbilled us for services not rendered in the first place. My boss really should have gotten the master keys back from the owner of said company before he fired her.

If you are fired, you are able to collect unemployment, aren't you? Isn't that the idea behind unemployment? When you quit, you can't collect, but,
the one time I was fired, I filed and was able to collect almost immediately.

I think it depends by state. Our unemployment is a state thing and here if you get fired you can't collect (though you can go through a hearing to
determine if you were at fault for being fired). You can't get it if you quit, but you can if you get laid off.

You can collect if you're "laid off". If you're fired for not doing the job properly or other such reasons (ex: stealing from the cash
register0, you don't get it.

In most states, if you are fired for cause you cannot collect unemployment. So basically you have to fight and show that you really did not deserve to be
fired, or that the reason for firing you was pretext and that it was really an economic move.

That's basically how it works here.
If you are fired for just cause, then no benefits. But just cause is basically on the felony level. Stealing etc. If you tell your boss to fuck off in the hea of the moment he cannot legally fire you unless he can prove that you were warned about it. Usually have to be warned three times depending on the offense. Also, if you feel you are unjustly fired, you file an appeal and it is up to the boss to prove that they had legal reason to fire you. Thus MOST companies do "lay-offs" except in the most extremem cases. Same with "quitting", but it is up to you to prove that you had a valid reason to quit. And most people in Canada do not know that you can quit and file for EI. In April 1995. I was workign the worst job of my life. Starting hours were either 8am or 6am My car quit. Boss said I had to start at 6am and I told him I couldn't because the bus doesn't run at that time. He said too bad. I quit on Monday. Other boss almost fired the guy for letting me quit. Filed for EI. Had to fill out extra form detailing why I quit. Delayed my for about 2 weeks, but I won without even having to appear. Collected EI. Found my 2nd job - which is a story in itself - anyone remember my story about closing my eyes and sending out a random resume??? Anyhows, the bottom line is you can quit or get fired and still collect EI - just be smart about it. They can't fire you for being late once or twice. If you think you are on the block unjustly, document why early and bring it with you when you file. Up here even if you get caught stealing thee employer still has to prove that you did it, if they cannot you are still elgible for EI. Not that I'm recommending stealing. Thos also a "3 strikes" rule. Verbal Warning. Written Warning, Another Written Warning - then you're fired. If the employer cannot prove that sequence (for msot cases) then you are eligible. Same with quitting, except that it is up to you to prove that you have a valid reason to quit. Apparently buses not running is valid. I recommend anyone that is fired to file immediately. Bring documentation etc etc. Now I better gt off of this site before I get a warning. |

I've had to fire associates, it's not fun, even when the person getting the hook is a useless waste of space. in my position, unless I've
documented the reasons in triplicate, I'm not allowed to give a reason beyond "it's just not working out". otherwise, they can come back with
"you never told me I was doing that wrong, etc" and could fight it.
typically, they're either let go when they come in for a shift, or at the end of one. being retail, we just want them out of the store, since they could cause all sorts of trouble. they're paid for the shift if it's at the beginning of it. I've been fired twice, and while it stings, neither job was missed. with the most recent one, I was home sick with pneumonia, and was called at 9:30 at night and told "we're gonna have to cut you loose" by the dickhead manager I hated. he said it was because I didn't show up for my shift that day. I asked him if he got my doctor's note and explanation the prior week that explained why I couldn't work for 10 days, and he said yes. I asked him why he had scheduled me then, since the day in question was day 5. he stuttered and sputtered, and hung up on me. (btw, he never called me and told me about the shift, either, I had no idea I had missed it) here in Ontario, you can't quit without a damned good reason and expect to get EI. about 5 years ago, I quit a job and was denied EI. I sent in an 8 page appeal, citing their own documents that list the allowable reasons to quit a job and how they applied to me. I still had to go before an appeal board of 4 scary Church-Elder looking old men who glared at me the whole time. my ex-manager actually came and "testified" on my behalf about how my hours had gone down, and I was being harassed by another manager and other reasons I had listed for quitting. the board thanked me for my time and said they'd be in touch. I was sure I had blown it, but two days later, I got a very nice letter with their ruling, which stated that my being denied was the worst mistake they'd seen come before them in a long time, and they actually apologised to me for the system having wasted my time!

My department is getting closed by the end of this year. One person was told she's going, and is hanging around pondering. One doesn't know he's
going yet, although the hints couldn't have been stronger.
They want me to stay on, doing the planning, review & estate admin without the prep. Unfortunately, the prep was our revenue source, so the whole thing makes little sense. Anyhow, I've got a ton to do through mid-October. There's at least 3 months to work out whether its a promotion or time to flee. |

I've fired many people-but usually they know its coming anyway.
but I agree 6 in one day is something else--their cutting expenses or something. considering its a law firm--i think they've left themselves open for some legal action. either that or all 6 are running a drug ring.

i worked for gametap when they first opened, they did a bad job predicting what size staff they needed early on, we had 300 people, that number got cut to 150
in a week, they did the last in, first out method. problem with that is that a lot of the quality employees got booted and alot of the slackers stayed. for the
next round of lay-offs(100 more people) they waited until payday, even if you did direct deposit they had you come in, the envelope would have one of two
sheets, an orange sheet of paper informed you that your job was safe, a pink paper meant you were fired immediately.
